Location Information Terms of Use

These Terms of Use are intended to stipulate the rights, obligations, responsibilities, and other necessary matters between the Company and the individual location information subject regarding the location-based service business provided by Place & Co., Ltd. (hereinafter referred to as the Company).

Article 1 (Purpose)
Effectiveness and Amendment of the Terms of Use

  1. These Terms of Use become effective when the individual location information subject agrees to these Terms of Use and the Now Waiting Service Terms of Use and registers as a member to use Now Waiting and additional services.

  2. If the individual location information subject expresses consent to these Terms of Use, it is deemed that they have read and fully understood the entire contents of these Terms of Use and agree to their application.

  3. The Company may revise these Terms of Use to the extent that it does not violate relevant laws, including the Act on the Protection and Use of Location Information, the Content Industry Promotion Act, the Act on Consumer Protection in Electronic Commerce, etc., the Framework Act on Consumers, and the Act on the Regulation of Terms and Conditions.

    If the Company revises these Terms and Conditions, it will announce the existing and revised Terms and Conditions, the effective date of the revised Terms and Conditions, and the reasons for the revision, along with the current Terms and Conditions, from seven days prior to the effective date until the day before the effective date. However, if the revision is disadvantageous to the Personal Location Information Subject, the Company will notify the Personal Location Information Subject of the change via electronic means, such as email or electronic message, within a certain period of time, in addition to the public notice.

  4. If the Company notifies the Personal Location Information Subject in accordance with the preceding paragraph, and the Personal Location Information Subject does not express objection within seven days of the effective date of the revised Terms and Conditions, the Personal Location Information Subject will be deemed to have agreed to the Terms and Conditions. If the Personal Location Information Subject does not agree to the revised Terms and Conditions, the Personal Location Information Subject may terminate the Service Agreement.


Article 2 (Definitions)
Effectiveness and Changes to the Terms and Conditions

  1. These Terms and Conditions shall take effect when the Personal Location Information Subject agrees to these Terms and Conditions and the Now Waiting Service Terms and Conditions and registers as a member to use Now Waiting and additional services. If the personal location information subject expresses consent to these Terms and Conditions, it is deemed that they have read and fully understood the entire Terms and Conditions and consent to their application.

  2. The Company may revise these Terms and Conditions as long as it does not violate relevant laws and regulations, such as the Act on the Protection and Use of Location Information, the Content Industry Promotion Act, the Act on Consumer Protection in Electronic Commerce, etc., the Framework Act on Consumers, and the Act on the Regulation of Terms and Conditions.

  3. If the Company revises these Terms and Conditions, it will specify the existing and revised Terms and Conditions, the effective date of the revised Terms and Conditions, and the reason for the revision.

    The Company will announce the revisions along with the current Terms and Conditions from seven days prior to the effective date until the day before the effective date. However, if the revisions are unfavorable to the personal location information subject, the Company will notify the personal location information subject of the changes via electronic means, such as email or electronic message, in addition to the public notice.

  4. If the Company notifies the personal location information subject pursuant to the preceding paragraph, but the personal location information subject does not express objection within seven days of the effective date of the revised Terms and Conditions, the subject will be deemed to have approved the Terms and Conditions. If the individual location information subject does not agree to the revised terms and conditions, the individual location information subject may terminate the service agreement.


Article 3 (Rules Other than Terms and Conditions)
Matters not specified in these Terms and Conditions shall be governed by relevant laws and regulations, including the Act on the Protection and Use of Location Information, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Framework Act on Telecommunications, and the Telecommunications Business Act, as well as the Company's Terms of Use, Personal Information Processing Policy, and guidelines separately established by the Company.

  1. The Company receives the individual location information subject's location information from a location information service provider and provides the following location-based services.

    • ​Waiting and Ordering Services Using Location Information: When the location information of the individual or a mobile device is provided, waiting or ordering services are provided at affiliated stores accessible based on this location information.

    • Search Results Service Using Location Information: When requesting information or providing the location information of the individual or a mobile device, search results and nearby results (such as affiliated stores) are provided using this location information

    • Advertising Information Using User Location: When using search results or other services, advertising materials are provided using the location of the individual or a mobile device.

  2. The location-based services described in Paragraph 1 are free of charge. However, mobile network access to verify location information may incur communication charges. These charges may vary depending on the customer's data usage and mobile carrier.


Article 4 (Service Content and Usage Fees)

  1. The Company receives the location information of the individual or a mobile device from a location information service provider and provides the following location-based services.

    • ​Waiting and Ordering Services Using Location Information: When the location information of the individual or a mobile device is provided, waiting or ordering services are provided at affiliated stores accessible based on this location information.

    • Search Results Service Using Location Information: When requesting information or providing the location information of the individual or a mobile device, search results and nearby results (such as affiliated stores) are provided using this location information.

    • Advertising Information Using User Location: When using search results or other services, advertising materials are provided using the location of the individual or a mobile device.

  2. The location-based services described in Paragraph 1 are free of charge. However, mobile network access to confirm location information may incur communication charges. These charges may vary depending on the customer's data usage, mobile carrier, etc.


Article 5 (Rights of the Individual Location Information Subject)

  1. The individual location information subject may withhold consent regarding the scope of personal location information collection, the purpose of use and provision of personal location information, the scope of recipients, and certain aspects of location-based services. The personal location information subject may withdraw all or part of their consent to the collection, use, and provision of personal location information at any time.

  2. The personal location information subject may request a temporary suspension of the collection, use, and provision of personal location information at any time. In such cases, the Company will not reject the request and will take technical measures to facilitate such suspension.

  3. The personal location information subject may request the Company to review or provide notice of the following data, and may request corrections if any errors are found in the data. In such cases, the Company will not reject the request without just cause.

  4. Data confirming the use and provision of location information for the personal location information subject

  5. Reasons and details of the provision of the personal location information subject's personal location information to a third party pursuant to the Act on the Protection and Use of Location Information or other laws and regulations

  6. If the personal location information subject withdraws consent, in whole or in part, the Company will promptly destroy the collected personal location information and the data confirming the use and provision of location information. However, if consent is partially withdrawn, this will be limited to the portion of the personal location information and the data confirming the use and provision of location information for which consent is withdrawn. The personal location information subject may exercise the rights set forth in Paragraphs 1 through 4 in accordance with procedures established by the Company.

    • If the Company intends to collect, use, or provide personal location information from a child under 14 years of age, it must obtain the consent of the child and his or her legal representative.

    • If the Company intends to use or provide personal location information or location information use/provision verification data of a child under 14 years of age beyond the scope specified or notified in the Terms of Use or to a third party, it must obtain the consent of the child and his or her legal representative. However, exceptions may be made if location information use/provision verification data is required for billing purposes for location-based services, or if the data is processed and provided in a form that renders specific individuals identifiable for purposes such as compiling statistics, academic research, or market research.

    • If the Company collects, uses, or provides personal location information of a child under 14 years of age, the legal representative may exercise the right to withhold consent, withdraw consent, suspend the use, and request access and notification.


       

Article 6 (Rights of Legal Representative)
The Company uses location information to provide the services stipulated in Article 4, Paragraph 1 of these Terms and Conditions to the individual location information subject. Location information is not stored in the system during the processing of the individual location information.

Article 7 (Purpose and Retention Period of Personal Location Information)
Pursuant to Article 16, Paragraph 2 of the Act on the Protection and Use of Location Information, the Company automatically records location information use and provision confirmation data for the individual location information subject in the location information system and retains it for six months.

Article 8 (Basis for Retention and Retention Period of Location Information Use and Provision Confirmation Data)

  1. If the Company is unable to maintain the service due to changes in the location information service provider's policies, the Company's circumstances, or legal obstacles, the Company may restrict, change, or suspend all or part of the service.

  2. In the event of a service suspension pursuant to Paragraph 1, the Company shall provide advance notice on the website or notify the individual location information subject.


Article 9 (Changes and Suspension of Services)

  1. The Company shall not provide the personal location information of the subject of personal location information to any third party without the consent of the subject of personal location information. When providing third-party services, the Company shall notify the subject of the recipient and purpose of the provision in advance and obtain consent.​

  2. ​​When providing personal location information to a third party designated by the subject of personal location information, the Company shall promptly notify the subject of the recipient, date and time of provision, and purpose of provision via the communication terminal used to collect the personal location information. However, in the following cases, the Company shall notify the subject of the information via a communication terminal, e-mail, or electronic message specifically designated by the subject of personal location information in advance

  • ​If the communication terminal device used to collect personal location information does not have a text, voice, or video reception function,

  • ​If the personal location information subject has requested notification in advance via a communication terminal device other than the communication terminal device used to collect personal location information, email, or electronic message, etc.

     

Article 10 (Immediate Notification When Personal Location Information is Provided to a Third Party)

  1. If the guardian of a child under the age of 8 (hereinafter referred to as a "child under the age of 8") who falls under any of the following cases consents to the use or provision of personal location information for the purpose of protecting the life or body of the child under the age of 8, the Company shall deem the consent of the child under the age of 8.

  • Children under 8 years of age

  • Incompetent persons​.

  • ​Persons with mental disabilities as defined in Article 2, Paragraph 2, Subparagraph 2 of the Welfare of Persons with Disabilities Act and who are severely disabled as defined in Article 2, Subparagraph 2 of the Act on Promotion of Employment and Vocational Rehabilitation of Persons with Disabilities (limited to persons registered as disabled as defined in Article 29 of the Welfare of Persons with Disabilities Act)

  1. A guardian who wishes to consent to the use or provision of personal location information to protect the life or body of a child under 8 years of age, etc., must attach a written consent form proving that he or she is the guardian must be submitted to the company.

  2. If a guardian consents to the use or provision of personal location information of a child under the age of 8, the guardian may exercise all rights of the individual location information subject.

     

Article 11 (Rights of Guardians of Children Under the Age of 8)

  1. If a guardian of a child under the age of 8 (hereinafter referred to as a "child under the age of 8") who falls under any of the following cases consents to the use or provision of personal location information for the purpose of protecting the life or body of the child under the age of 8, the Company deems the child's consent.

    • ​Children under the age of 8

    • Incompetent Persons

    • Persons with a mental disability as defined in Article 2, Paragraph 2, Subparagraph 2 of the Act on Welfare of Persons with Disabilities, and persons with severe disabilities as defined in Article 2, Subparagraph 2 of the Act on Promotion of Employment and Vocational Rehabilitation of Persons with Disabilities (limited to persons registered as disabled as defined in Article 29 of the Act on Welfare of Persons with Disabilities)

  2. A guardian who wishes to consent to the use or provision of personal location information for the protection of the life or body of a child under the age of 8, etc., must submit a written consent form to the company along with a document proving their status as the guardian.

  3. A guardian who consents to the use or provision of personal location information of a child under the age of 8, etc., may exercise all rights of the personal location information subject.


Article 12 (Compensation for Damages)

  • If the personal location information subject suffers damages due to the company's violation of Articles 15 through 26 of the Act on the Protection and Use of Location Information, the personal location information subject may claim compensation for damages from the company. In this case, the Company cannot avoid liability unless it can prove that there was no intent or negligence.

  • If the personal location information subject violates the provisions of these Terms and Conditions and causes damage to the Company, the Company may claim compensation for damages from the personal location information subject. In this case, the personal location information subject cannot avoid liability unless it can prove that there was no intent or negligence.


Article 13 (Exemption from Liability)

  • The Company shall not be liable for any damages suffered by the personal location information subject due to the Company's inability to provide the Service in the following cases:

    • 1. In the event of a natural disaster or other force majeure.

    • 2. In the event of intentional service disruption by a third party that has entered into a service partnership agreement with the Company for the purpose of providing the Service.

    • 3. In the event of service disruption due to the fault of the personal location information subject.

    • 4. Except for cases listed in Items 1 through 3, if the Company is not at fault or negligent, the Company does not guarantee the reliability or accuracy of the Service or the information, data, or facts posted on the Service. The Company is not responsible for any damages suffered by the individual location information subject arising therefrom.

  • The Company appoints a Location Information Manager who possesses substantial responsibility for the proper management and protection of location information and the smooth handling of complaints from individual location information subjects. The Company discloses the status of such appointment through the Supplementary Provisions.


Article 14 (Designation of Location Information Manager)
These Terms and Conditions are governed by and implemented in accordance with the laws of the Republic of Korea. Matters not stipulated herein shall be governed by relevant laws and customs.

Article 15 (Application of Regulations)

  • If the Company fails to reach an agreement with the individual location information subject regarding a dispute related to location information, or if such agreement is not possible, the Company may apply for arbitration to the Korea Communications Commission. If the parties to a dispute regarding location information fail to reach an agreement or are unable to reach an agreement, the company or individual location information subject may apply for mediation to the Personal Information Dispute Mediation Committee pursuant to the Personal Information Protection Act.

Supplementary Provisions
These Terms and Conditions shall take effect on July 4, 2025.

Article 1: Effective Date
The company shall designate a location information manager as follows to handle complaints arising from the use of the service and to protect the rights of personal location information subjects.

Article 2 (Location Information Manager Information)
The company appoints a location information manager as follows to handle user complaints arising from the use of the service and to protect the rights of individual location information subjects.
